Terms and Conditions

Welcome to Rock the Score. Your access and use of this website, features, products and services are provided by Rock The Score LLC (“Rock The Score,” “we,” “us,” or “our”) is subject to these terms and conditions.

These Terms of Service (the “Agreement”) govern the use of the website and Services (as defined herein) provided by Rock The Score LLC. By accessing our website and Services, you hereby accept and agree to be bound by this Agreement (as may be amended from time to time). By accepting the terms and conditions or using the Service, you represent and warrant that you have the legal capacity to enter a contract in the jurisdiction where you reside. If you do not accept these terms and conditions, then you may not use the Service.  Please read this entire Agreement.

References to “you”, “your”, “member(s)” and “enrollee(s)” mean any person using our website or Services. Unless stated otherwise, “Rock The Score LLC” “we” and “our” refers to Rock The Score LLC, Inc. Capitalized terms not otherwise defined have the definitions set forth herein. This Agreement (and any other agreement that you agree to in connection with your use of the Services) constitutes the entire contract between you and Rock The Score LLC and supersedes any oral or written representations that may be given at any time. You also agree to any other specific Terms of Use relating to use of any of our Services.

Cancellation Policy

You are eligible to receive a full refund of the enrollment fee and any verification fees if we are unable to contact your landlord or management companies for the purpose of verifying your rental payment history and/or your current rent payment.

If you wish to cancel your enrollment, you MUST contact us within 15 days and request cancellation of reporting and request a refund. Without exception ALL Refund Requests must be made in writing within 15 days of the initial application to Rock The Score LLC. Any requests made after 15 days will not be processed a refund.

In the event of a cancellation, no information will be reported to the credit bureau(s).

Refunds are processed within 1-3 business days of request, and may take 3-7 days for the refund to reflect on your debit or credit card.

Processing Your Enrollment

To process an enrollment, Rock The Score LLC requires assistance from our enrollees.

Full completion of our enrollment process is required, which includes responding to all requests for additional information etc. If we do not receive a response from you within 15 days of your enrollment, your account with Rock The Score LLC will be cancelled and your enrollment fee with not be refunded.

Non-Responsive Enrollments

Our team wants to ensure that your rental payments get reported as soon as possible and will contact you for any missing items or incomplete data on your enrollment.

We will continue to email and call for you any missing items, however if your enrollment is not complete due to missing or incomplete information that we have requested from you we will move your enrollment to a Non-Responsive Status and cancel your enrollment.  You will be charged a $48 fee and we will process a refund on any additional charges that you paid at the time of enrollment.

NO REFUNDS IF:

If you attempt to provide false information to our company.

If you attempt to report a private mortgage. 

If you attempt to report an illegal sublease.

If you attempt to report a commercial property.

If you move out, please let us know as soon as you can, so we can update your account.

We do send monthly verification’s to your landlords or property management company, if we do not get a response from them for a consecutive 2-month period we will reach out to our member to see if you have moved or need to cancel ongoing services, no monthly fees will be reimbursed.

Self-Reporting

Self-Reporting is an option for members to upload rental payment verification information to us, acceptable forms of data would be the following:

  • Cancelled or cleared check from your bank
  • Copy of the ledger from Property Management Company
  • Copy of bank statement showing paid rental amount

Your Privacy

Maintaining the confidentiality of our Members is always a top priority for us. Our Privacy Policy discusses our responsibilities with respect to your data and Information.

Please review our Privacy Policy in order to better understand our commitment to maintaining your privacy, as well as our use and disclosure of your Information.

Rock The Score LLC may amend and/or revise this Agreement from time to time, in our sole discretion, by sending you written notice by electronic mail, by regular mail or by posting the updated terms on our website. Such modifications will become effective at the date or time provided in such notice but in no event earlier than twenty-four (24) hours following the earlier of receipt by you or the posting on our website at www.rockthescore.com  Should you find this Agreement unacceptable to you at any time, please discontinue your use of the Services. Your use of the Services after we have made such changes available will be considered your consent and agreement to the change. We also may, from time to time, introduce new features to the Services or modify or delete existing features at our sole discretion. We shall notify you of any of these changes to features if we are legally bound to do so. By using any new or modified features when they become available, you agree to be bound by the rules concerning those features.

General Service Provider

Rock The Score LLC provides services relevant to renters, roommates, landlords, property managers, and others, which may include additional services such as credit reporting and credit-related products.

Eligibility

To be eligible to use our Services, you must be an individual at least 18 years of age that is able to form legally binding contracts under applicable law and a resident of the United States and Puerto Rico with a postal mailing address in the United States or Puerto Rico.

Identity Authentication

To help the government fight terrorism and money laundering activities, we obtain, verify and sometimes store personal information. You authorize Rock The Score LLC, directly and through third parties, to make any inquiries we consider necessary to verify your identity. This may include asking you for further information, requiring you to take steps to confirm ownership of your email address or financial account and verifying your information against third party databases or through other sources. If we cannot verify your information to the extent, we deem necessary, we may not be able to allow you to use our Services and you may be eligible for a full refund.

Credit Reporting Services

Rock The Score LLC will report rental payments made by you to a credit reporting agency (a “CRA”), or a third party that reports such rental payments to a CRA which in part is designed to assist parties in establishing a credit history and/or a credit score. Once payments have been reported by Rock The Score LLC to a CRA or third party, the reporting of those payments cannot be modified, amended or canceled.

Rent reporting is reported as a FICO-9 and VantageScore and may not appear on other FICO® versions.

Rental Payment History

Rock The Score LLC will need to verify the existence of a valid written lease, including verifying that the Member is listed as a lessee. Additionally, Rock The Score LLC will need to verify certain lease details with the landlord, i.e. the lease payment amounts due and due dates. If Rock The Score LLC is unable to verify any and all necessary information for reporting, Rock The Score LLC may not necessarily contact the Member and will not be able to report the Member’s payments to any CRA or third party agency. Notwithstanding the above, any party may dispute any entry on a credit report provided by Rock The Score LLC to a CRA. See Rock The Score’s Credit Reporting Dispute Resolution Policy, which is incorporated herein and made a part hereof.

Verification Fee

Rock The Score LLC is not a rental verification payment platform and must independently verify the Member’s rental payments with the Landlord or Vendor each month to verify that the Member is maintaining their payment agreement and making all applicable payments. As such Rock The Score LLC charges a monthly verification fee for ongoing payments. If a Member wishes to verify past rent or utility payments there’s also a verification fee for past payments that are verified. Additionally, there is a one-time enrollment fee to authenticate your account and register as a subscriber with Rock The Score LLC.

Restricted Activities

In connection with your use of our website and our Services, or in the course of your interactions with Rock The Score  LLC or a third party through Rock The Score LLC you agree that you will not: Activate multiple registrations without prior consent by Rock The Score LLC, whether such registration was completed fraudulently, falsely or unlawfully, or by legitimate and lawful means such as the use of alternate but valid names, different contact information, separate bank-account numbers and other pertinent data Undertake any fraud, intentional or negligent misrepresentation or any unlawful act relating to the use of Rock The Score’s website or Services or otherwise provide false, accurate or misleading information or otherwise participate in a fraudulent transaction, including, without limitation, providing payment source information that you have not been authorized to provide or use.

Breach this Agreement or any other agreement that you have entered into with Rock The Score LLC (including any policy to which you become subject) Violate any law, statute, ordinance or regulation in connection with your use of the Services or access of our website Infringe Rock The Score LLC or any third party’s copyright, patent, trademark, trade secret or other intellectual property rights or rights of publicity or privacy. Refuse to cooperate in an investigation or provide confirmation of your identity or any Information you provide to us Interfere with or damage our Services, including, without limitation, through the use of any viruses, Trojan horses, worms, cancel bots, harmful code, flood pings, denial of service attacks, packet or IP spoofing, forged routing or electronic mail address information or other computer programming routines, methods or technology that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information Notices to You.

You agree that Rock The Score LLC may provide notice to you by posting it on our website, emailing it to the email address listed in your account or mailing it to the street address listed in your account. Such notice shall be considered to be received by you within 24 hours of the time it is posted to our website or emailed to you unless we receive notice that the email was not delivered. If the notice is sent by mail, we will consider it to have been received by you three (3) Business Days after it is sent. You also consent to allow Rock The Score LLC to respond to any inquiries by e-mail regardless of the format of the original inquiry. You may request a paper copy of any legally required disclosures, and you may terminate your consent to receive required disclosures through electronic communications by contacting Rock The Score LLC.

Rock The Score LLC reserves the right to close your account if you withdraw your consent to receive electronic communications. You further agree to the Electronic Signature and Uniform Electronic Transactions Act Disclosure and Consent Agreement provided herein, which is incorporated herein. Notices to Rock The Score LLC. Except as otherwise expressly stated herein, notice to Rock The Score LLC must be sent by postal mail to: Rock The Score LLC, 3770 S Lindbergh Blvd, Suite 101, St. Louis, MO 63127.

Termination by Rock the Score LLC

We, at our sole discretion, reserve the right to terminate this Agreement, access to our website or access to the Services or cancel your usage for any reason and at any time upon notice to you. If we close your account, terminate your use of our Services or cancel your ability to access the Services for any reason, we will provide you with notice of our actions. If we limit access to your account, we will provide you with notice of our actions and the opportunity to request restoration of access, if appropriate. An individual whose account is terminated or Services cancelled may be denied further access to the secure portion of our website and future use and enjoyment of the Services. Members will remain liable for all outstanding obligations to Rock The Score LLC under this Agreement even after any such termination.

Dispute of Credit Reporting Information by Client Notice of Dispute

A Member may dispute an entry on their credit report derived from information provided by Rock The Score LLC to a CRA by notifying Rock The Score LLC either by mail or email support@rockthescore.com or by other means available to the Member. The Member shall provide the following information as part of any dispute of information provided by Rock The Score LLC.

The investigation shall include, but is not limited to, all relevant information provided by the Member. The determination shall be one of the following options:

  1. The dispute is irrelevant and the information originally provided is accurate;
  2. The disputed information is inaccurate; or more information is necessary to make a final determination regarding the disputed information.
  3. Notification of Determination. Once a final determination has been made regarding the disputed information, Rock The Score LLC will notify the Member within five (5) Business Days of the determination regarding the disputed information. If Rock The Score LLC determines that the dispute is frivolous or irrelevant, Rock The Score LLC shall notify the Member by mail or, if authorized by the consumer for that purpose, by other means available to Rock The Score LLC. Said notice shall include: The reasons for the determination; and Identification of any information required to investigate the disputed information. If Rock The Score LLC determines that the disputed information is inaccurate, Rock The Score LLC shall notify the Member by mail or, if authorized by the consumer for that purpose, by other means available to Rock The Score LLC within five (5) Business Days of the determination and will promptly notify all credit reporting agencies (“CRA”) or third parties to which Rock The Score LLC provided said information and request that they delete or modify the information as appropriate.

If Rock The Score LLC determines that more information is necessary to complete its investigation, Rock The Score LLC will notify the Member and request additional information to help make a final determination as to the disputed information.

Privacy Policy

We are always committed to respecting the privacy rights and concerns of all users of Rock the Score website and the services we make available to our members. As such, we have established and implemented this Privacy Policy to inform visitors to the Site and members of the Service how we use and protect the information we collect through the Service.

By accessing the Site or using any of the Service, you consent to our collection, use, storage, deletion and disclosure of information relating to you as set forth in this Privacy Policy.

  1. What information do we collect about you and how do we use it?

We Collect Personal information that can be used to identify and contact you.

This could include (but not limited to) your full name, address, IP address, date of birth and Social Security number.

To create an account through our Service, we require you to provide (i) if you are a renter, certain personal information about yourself (name, email address, password, phone number, date of birth, social security number, property address and prior property address), personal information of your landlord or property manager (name, phone number, email and address), rental information (rent amount and payment dates) and any information necessary for us to verify and validate the information with your landlord or property manager and (ii) if you are a landlord or property manager, your personal information and personal information of your tenants, and rental information. Some of the personal information we collect when you register, like your social security number, is required by the credit bureau to verify your identity. Your contact information will only be made available to other users as authorized by you in connection with the property address you submit.

You will also be required to provide a credit card number, billing address, phone number or other payment information. No information of this type will be collected unless you have registered for aspects of the Service that require it.

By submitting personal information through the Site, you authorize Rock the Score to share this personal information for the purposes identified herein and on the site, such as responding to user inquiries, processing transactions, distributing materials, and requesting feedback. In addition to the information that you provide to us, we automatically record other personal information such as your browser type and the date and time of Service access.

  1. How We Use Your Personal Information

When you register for our Services, we use the personal information you provide to us to verify your identity, communicate with you, and provide the Service to you, depending on the aspects of the Service for which you register. This includes verifying your identity, property address, and rent amount; reporting your information to third party credit bureaus; obtaining your credit score and excerpts of your credit report before and after the initial reporting of your rental history to the credit bureaus; alerting you of new products, services, features, or enhancements to the Service; handling your customer service questions or issues; processing orders; requesting feedback; distributing newsletters; and administering contests, promotions or surveys. We may also use your email address and phone number as part of the Service in sending you messages about the Service and other general announcements. We keep track of your interactions with us, including but not limited to your activity within the Service. We will not share your personal information with any person or entity other than those affiliated with us, entities acting on our behalf, and relevant third parties such as those needed to verify data and report to the credit bureaus.

  1. Google Analytics

Rock the Score uses Google Analytics to help us learn about who visits the Site and what pages are being viewed.

  1. Cookies

“Cookies” are small bits of electronic information that a website sends to a visitor’s browser and are stored on the visitor’s hard drive. Like many websites, we employ cookies in certain areas of the Site to allow us to provide information to make your online experience more convenient. For example, when you return to the Site after logging in, cookies provide information to the Site so that the Site will remember who you are on subsequent visits, speeding up or enhancing your experience.

While we may use cookies to track your visit to the Site, this information does not identify you personally even if you have previously submitted personal information to us through the Site, Platform or otherwise. Most browsers are initially set to accept cookies. You can set your browser to notify you when you receive a cookie, giving you a chance to decide whether or not to accept it.

We use your personal information to provide the Service to you, deliver products and services you request, complete transactions, handle your customer service questions or issues and send communications to you about promotions, updates, or special offers that may be of interest to you.

  1. Notification of Changes

This Privacy Policy may change from time to time and we will post all changes on the Site.

  1. Promotional Purposes

Questionnaires and Surveys – we occasionally may ask visitors to our website to complete online surveys and opinion polls about their activities, attitudes and interests. Comments and notes that you post to the bulletin board and similar areas of our website, social media, marketing platforms etc. may be used for promotional purposes or testimonials on our website, social media platforms and marketing of Rock The Score LLC without limitation or additional permission.

Before permitting you to use our Service, we may require you to provide additional information we can use to verify your identity or address to manage risk. We may also obtain information about you from third parties such as credit bureaus and identity verification services. When you are using our Service, we collect information about your account transactions, and we may collect information about your computer or other access device for fraud prevention purposes. Finally, we may collect additional information from or about you in other ways not specifically described here. Throughout this policy, we use the term “personal information” to describe information that can be associated with a specific person and can be used to identify that person. We do not consider personal information to include information that has been anonymized so that it does not identify a specific member. We store and process your personal information on our servers in the US, and we protect it by maintaining physical, electronic and procedural safeguards in compliance with applicable US federal and state regulations.

We use computer safeguards such as firewalls and data encryption, we enforce physical access controls to our buildings and files, and we authorize access to personal information only for those employees who require it to fulfill their job responsibilities. Our primary purpose in collecting personal information is to provide you with a safe, smooth, efficient, and customized experience on the Rock The Score LLC site.

We may use your personal information to: Provide the services and customer support you request, as well as send you transaction-specific email correspondence; Process transactions and send notices to you and your payees about your transactions; Resolve disputes and troubleshoot problems; Prevent potentially prohibited or illegal activities, and enforce our Member Agreement; Customize, measure, and improve our services and the content and layout of our website; Send you targeted marketing, service update notices, and promotional offers based on your communication preferences; and Compare information for accuracy and verify it with third parties. In addition, we may append your information with additional information obtained from third parties. We may share your personal information with: Service providers under contract who help with parts of our business operations (fraud prevention, compliance, bill collection, marketing, technology services). Our contracts dictate that these service providers only use your information in connection with the services they perform for us and not for their own benefit. Third party financial institutions that we partner with to process EFT and card payments. These financial institutions may only use this information to process transactions on your behalf, unless you have given consent for other uses. Credit bureaus to whom rental payments will be reported upon the purchase of the service. Companies that we plan to merge with or be acquired by. (Should such a combination occur, we would require that the new combined entity follow this privacy policy with respect to your personal information. If your personal information could be used contrary to this policy, you will receive prior notice.) Law enforcement, government officials, or other third parties when we are compelled to do so by a warrant, subpoena, court order or similar legal procedure we need to do so to comply with law we believe in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report suspected illegal activity, or to investigate violations of our Terms of Service.
